General Terms and Conditions of Sale
TPR (Teboulba Spare Parts)
1. Purpose
These general terms and conditions of sale govern all sales of automotive spare parts concluded between TPR and its professional or individual customers.
Any order implies the customer’s full and unconditional acceptance of these terms and conditions.
2. Orders
- Orders may be placed in-store, by phone, email, or through our online platform.
- All orders are firm and final upon written confirmation by TPR.
- TPR reserves the right to refuse an order in the event of a previous dispute or stock shortage.
3. Prices
- Prices are expressed in Tunisian dinars (TND), excluding taxes, unless otherwise stated.
- TPR reserves the right to change its prices at any time; however, products will be invoiced according to the rates in effect at the time the order is recorded.
4. Payment
- Payment is required at the time of ordering, unless otherwise agreed.
- Accepted payment methods include: cash, bank transfer, online payment, check, or contractually agreed deferred payment.
- In case of late payment, penalties may be applied in accordance with applicable legislation.
5. Delivery
- Delivery times are provided for information only. Delays shall in no case justify order cancellation or compensation.
- Delivery fees are the responsibility of the customer, unless otherwise specified.
- Risk is transferred to the customer once the products are handed over to the carrier.
6. Claims and Returns
- Any claim (delivery error, visible defect) must be made within 48 hours of receipt of the goods.
- No returns will be accepted without TPR’s prior approval or after a period exceeding 8 days. Items must be returned in their original condition and packaging, along with the invoice.
- Electrical and electronic parts are neither returnable nor exchangeable.
7. Warranty
- Our parts are guaranteed against manufacturing defects for a period depending on the type and brand of the part.
- The warranty does not cover defects resulting from incorrect installation, improper use, or normal wear and tear.
- Warranty intervention does not extend the original warranty period.
8. Liability
- TPR’s liability is limited to the replacement or refund of defective parts.
- TPR shall not be held liable for indirect or intangible damages (such as loss of business, etc.).
9. Retention of Title Clause
Products remain the property of TPR until full payment has been made.
10. Disputes and Applicable Law
- These terms and conditions are governed by Tunisian law.
- In the event of a dispute, exclusive jurisdiction is assigned to the courts of Monastir, even in cases involving multiple defendants or third-party claims.
- All legal expenses incurred by TPR will be charged to the customer.
